BREXIT IMPACTS: COMMERCIAL CONTRACTS
Generally speaking, Brexit has had a limited impact on English contract law. However, the wider impact on obligations under contracts may be more significant along with parties’ bargaining positions, particularly in relation to tariffs, exchange rates and taxes.
Whilst not all contracts will be equally affected, we aim to set out some of the areas which businesses should consider in relation to their contracts.
THE IMPACT OF BREXIT ON IMMIGRATION LAW
The new Points-Based System which came into effect on 1st January 2021 requires UK employers who wish to employ European nationals, who have not applied for Settled or Pre-Settled Status prior to 31st December 2020, to obtain Sponsors Licences and Sponsorship Certificates to employ such individuals in exactly the same way as applies for all other foreign non-EU nationals at present.
THE IMPACT OF BREXIT ON EMPLOYMENT LAW
A significant proportion of the UK’s employment law comes from the EU, including discrimination rights, collective consultation obligations, transfer of undertakings regulations, family leave, working time regulations and duties to agency workers. Most EU-derived employment legislation remains applicable in the UK, unless and until altered by the government.
