Does a settlement agreement need to be witnessed?
A settlement agreement is a binding contract which defines how your employment term ends. Often it includes a severance payment which is conditional on an agreement by you as the employee not to pursue any claims you might have from your employment or its termination. Whether the signing of a settlement agreement is witnessed or not, employees should be mindful that the agreement is not ratified and legal until they have received legal advice from an independent adviser before signing it. Ellisons’ employment specialists are on hand to help you in exactly this situation, giving you all the guidance you need to fully understand the consequences of signing the agreement and can also make clear the value of the settlement offer against the potential of any claims you may have and on the amounts being offered.
