Cohabitation is defined as a couple who live together and are in a relationship but are not married. Simply living together does not provide ‘rights’ for either party, however by entering into a cohabitation agreement you can decide how the property and any other sole, or jointly owned, assets are split in the result of the relationship breaking down. This legally binding contract can also set out the living arrangements and which person will pay for what utility or service.
If you are considering living with your partner and putting a cohabitation agreement in place between you, then it is imperative to have it prepared, drafted and executed by a legal expert, like Ellisons, to ensure enforceability when necessary. What will be good for now will not always be good in the future, so if circumstances change and finances change then your agreement should be amended and updated with the help of a legal team to make it fit for purpose moving forward.
