What is business mediation?

Business mediation is a process of resolving disputes between businesses through a neutral third party mediator. It involves negotiating and reaching a mutually acceptable agreement that may avoid the need for litigation. The mediator helps parties to communicate effectively and find common ground to resolve their differences.

What is involved in business mediation?

Business mediation is a voluntary process to be entered into by parties involved in a commercial dispute, with the aim of finding a resolution to the issue with all parties in agreement and avoiding further legal action. If entered into early, mediation can be a cost-effective method of resolving disputes.

Benefits of business mediation

  • To preserve relationships between parties
  • Confidentiality, privacy and informality within the mediation process
  • Flexibility of solutions in mediation
  • A refusal to mediate can lead to the Court making an adverse costs order when the dispute reaches litigation

At Ellisons, we can assist in mediating business disputes concerning:

  • Shareholder disputes
  • Partner disputes
  • Debts
