What is personal insolvency?

Personal insolvency is the term used when a person has liabilities which exceed their assets in an unmanageable way, meaning that as a result an individual cannot pay their debts when they are due. Bankruptcy is one of the most common legal processes through which an individual’s financial affairs are managed to ensure that creditors are repaid as much as possible, while also aiming to provide a financial reset for the insolvent individual.

Other formal insolvency procedures for individuals are Individual Voluntary Arrangements (IVAs) and Debt Relief Orders.
