Health and Welfare
A Health and Welfare LPA can only be used once you have lost mental capacity and allows your Attorney to deal with decisions in relation to your personal welfare and medical decisions. This could be in relation to day to day living arrangements and any medical care and support you may require such as choosing a nursing home. Your Attorneys can also make decisions relating to life sustaining treatment if you wish.
Property and Financial
This document provides the right for your attorneys to make decisions in relation to your property and finances. It can be used, with your permission, whilst you still have mental capacity, or afterwards.
To ensure that the people you trust are able to make decisions on your behalf when you cannot, it is important to plan ahead and have the appropriate documents in place. This is why we advise many of our clients to make lasting powers of attorney (LPA). People often think that these documents are required later on in life; however; incapacity can arise at any time through accident and illness and therefore it is important to be prepared.
At Ellisons, we have an experienced team that will be able to help you and provide the advice that you require.
